MARYLAND HEIGHTS, MO (KTVI - FOX2now.com) - Tonight's Fox Files reveals a murder committed in front of a surveillance camera, and the resulting criminal charges that may surprise you. It happened outside of a crowded market in St. Louis County. The suspect was arguing with a group of people before he pulled two handguns from his waist band. Then he shoots and kills someone who's off camera.

One woman explained how "It just happened so fast. We didn't even see it coming."

Witnesses said the guy he was aiming for ducked -- and someone else took the bullet and died. But despite the video, prosecutors are not charging first degree murder. Tonight in the Fox Files, you'll hear from a former defense attorney to get answers. And you'll see the complete video, along with other angles. One angle shows the suspect running toward a busy intersection and firing repeatedly like a cowboy.

It's scary stuff that may leave you with questions about the legal system.
